Chapter I: Initiation and Completion of Administrative Proceedings. Book One: General Provisions. Administrative Code of the Republic of Moldova
Article 1. Administrative Legislation
(1) Administrative legislation is the main legal framework that ensures the regulation of administrative relations in the performance of administrative activity and judicial control over it.
(2) Administrative legislation is based on the constitutional norms developed in this Code, in other laws and in other normative acts subordinate to the law, which regulate administrative relations and which must be in accordance with the Constitution of the Republic of Moldova.
(3) Normative acts subordinate to the law shall apply to the regulation of administrative relations only in cases where they are issued on the basis of the law and do not contradict it.
Article 2. Regulation of administrative relations
(1) The provisions of this code determine the legal status of participants in administrative relations, the powers of public administrative authorities and courts competent for examining administrative disputes, the rights and obligations of participants in administrative and administrative litigation procedures.
(2) Certain aspects of administrative activity regarding specific areas of activity may be regulated by special legislative norms derogating from the provisions of this code only if such regulation is absolutely necessary and does not contradict the principles of this code.
(3) The provisions of this code do not apply to:
a) private law legal relations in which public authorities participate;
b) legal relations of public authorities acting on the basis of the Code of Contraventions or the Criminal Code;
c) acts subject to constitutional review by the Constitutional Court;
d) the procedure for drafting and adopting normative acts.
Article 3. The purpose of administrative legislation
Administrative legislation aims to regulate the procedure for carrying out administrative activity and judicial control over it, in order to ensure compliance with the rights and freedoms provided for by law of natural and legal persons, taking into account the public interest and the rules of the rule of law.
Article 4. Administrative legislation and international treaties
If an international treaty to which the Republic of Moldova is a party establishes provisions other than those provided for by administrative legislation, the provisions of the international treaty shall apply.
