Regulation of labor relations and other relations directly related thereto

  • (1) This code regulates all individual and collective labor relations, the control of the application of regulations in the field of labor relations, labor jurisdiction, as well as other relations directly related to labor relations.
  • (2) This code also applies to labor relations regulated by organic laws and other normative acts.
  • (3) If the court establishes that, by a civil contract, the labor relations between the employee and the employer are in fact regulated, the provisions of labor law shall apply to these relations.

Scope of this code

The provisions of this code apply to:

  • a) employees - citizens of the Republic of Moldova, working on the basis of an individual labor contract in the Republic of Moldova, including those who have concluded a contract for continuous professional training or a professional qualification contract;
  • b) employees – foreign citizens or stateless persons working on the basis of an individual employment contract with an employer operating in the Republic of Moldova;
  • c) employees – citizens of the Republic of Moldova working in diplomatic missions of the Republic of Moldova abroad;
  • d) employers – individuals or legal entities of the public, private or mixed sector using hired labor;
  • e) employees of public, religious associations, trade unions, patronages, foundations, parties and other non-profit organizations using hired labor.
  • f) temporary work agents, temporary employees and temporary labor users, as they are defined by this code.
