This code applies to labor relations regulated by organic laws and other regulatory acts.
In cases where a court determines that a civil contract actually regulates labor relations between an employee and an employer, the provisions of labor legislation shall apply to such relations.
The provisions of this code apply to:
a) employees - citizens of the Republic of Moldova, working on the basis of an individual labor contract in the Republic of Moldova, including those who have concluded a contract for continuous professional training or a professional qualification contract;
b) employees – foreign citizens or stateless persons working on the basis of an individual employment contract with an employer operating in the Republic of Moldova;
c) employees – citizens of the Republic of Moldova working in diplomatic missions of the Republic of Moldova abroad;
d) employers – individuals or legal entities of the public, private or mixed sector using hired labor;
e) employees of public, religious associations, trade unions, patronages, foundations, parties and other non-profit organizations using hired labor.
Labor relations and other relations directly related to them are regulated by the Constitution of the Republic of Moldova, this code, other laws, other normative acts containing labor law standards:
a) resolutions of the Parliament;
b) decrees of the President of the Republic of Moldova;
c) resolutions and orders of the Government;
d) labor acts issued by the Ministry of Labor and Social Protection, other central sectoral public administration bodies within the powers delegated to them by the Government;
e) acts of local public administration bodies;
f) normative acts at the enterprise level;
g) collective labor agreements and collective agreements; as well as
h) international treaties, agreements, conventions and other international acts to which the Republic of Moldova is a party.
