In Moldova, an attorney is an independent legal professional licensed to provide legal advice, draft legal documents, and represent clients in courts and government bodies.
The profession is regulated by Law No. 1260/2002 on Advocacy and self-administered through the Union of Advocates of the Republic of Moldova.
Requirements and Qualifications
- Education: Must hold a law degree (Licentiate in Law or equivalent).
- Traineeship: Must complete a professional traineeship (usually 18 months).
- Bar Exam: Must pass the national qualification examination to join the bar.
- Registry: Must be an active member registered with the national union (numbering over 2,000 active advocates nationwide).
Scope of Practice & Rules
- Monopoly on Representation: Only licensed attorneys have the full right to plead and represent clients in all court instances in criminal, civil, and administrative matters.
- Incompatibilities: Practicing attorneys cannot hold commercial jobs or public office (except for teaching and scientific research).
- Independence: The law guarantees the professional independence of attorneys and prohibits interference in their legal duties.
